By accessing or using the Service you agree to be bound by these Terms.
If you wish to purchase any product or service made available through the Service you may be asked to supply certain information relevant to your Purchase. Further information and terms for such services will be supplied separately at the time of order. If you subscribe to one of our paid subscription services, you will be billed in advance on a monthly basis. Your subscription can be terminated immediately without reference to you on a default in payment of the subscription fee.
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, photos, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us the right and licence to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You agree that this licence includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms. You agree that all photos that you upload through our upload form are published and licence under the Creative Commons Zero licence.
You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and licence as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
Our Service relies upon the accuracy of data provided by third parties and may contain links to third-party web sites or services that are not owned or controlled by JGrah.am Limited. JGrah.am Limited has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.
JGrah.am Limited shall not be liable for any failure or delay in delivering the Services resulting from circumstances beyond its reasonable control (Force Majeure). If JGrah.am Limited invokes Force Majeure, it will all reasonable things within its power to end the circumstances causing the Force Majeure and to mitigate any losses that the Customer may suffer as a consequence thereof. However, under no circumstances will JGrah.am Limited have any liability to you for any loss suffered.
You further acknowledge and agree that JGrah.am Limited shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on the Services.
These Terms shall be governed by the laws of New Zealand and the parties agree to submit to the exclusive jurisdiction of New Zealand courts.
If any term is held by any court to be illegal, void or unenforceable, such determination shall not otherwise impair the enforceability of the remaining parts of these Terms.
GIS Geek and its features are the intellectual property of JGrah.am Limited.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
